Guardian - person, who is assigned or endorsed in order prescribed in Civil law to ensure protection of child’s rights and best interests. Guardian for his dependant substitutes parents and represents it in private and property relations.
In which cases orphan’s court can assign guardian for child?
Orphan’s court can assign guardian, if:
- child’s parents are unknown;
- child’s parents are missing or dead;
- parents lie up and are no able to ensure guardianship;
- parents right to maintenance or guardianship are disabled.
How to become a guardian?
1. Person, who wants to become a guardian, hands in an application form in orphan’s court according place of residence. Court defines additional documents to be handed in.
2. Orphan’s court appraises person’s skills and qualities to become a guardian.
3. Orphan’s court makes a decision to confer or not guardian status.
What kind of support receives guardian?
- State social allowance for each dependant is 32 lats monthly. If guardian, in a case when child has lost his breadwinner, becomes a pension, state social guarantee allowance that is grant for breadwinners’ loss, or family state allowance, then allowance for child’s maintenance is cut regarding according sum.
- Compensation for discharge of guardian duties is 38 lats monthly. Compensation does not depend on number of children taken in guardianship.
- All state social allowances for families with children.
Allowances and compensations are granted with the day orphan’s court has carried out a decision about persons assignment as guardian. Allowances and compensations allocate affiliates of State social insurance agency according guardians place of residence.
